Kiddy Porn or Family Photo??

Can you tell the difference between a kiddy pornographic photo and a family photo? If you cannot tell the difference or do not know the legal difference, you should not be taking photos of your minor children or grandchildren. The child pornographic laws have changed. While I applaud child pornographic laws, I also believe that we (the public) are entitled to specific definitions of what is child porn.Presently child porn is in the eye of the beholder. What Grandma might consider “cute”, a hardened criminal investigator might consider child pornography. The test is not what is

Justice with the sense of humor

If you think going to courts is boring think again. Here are some example of brilliant questions asked by attorneys and some pretty clever comebacks. ATTORNEY: Doctor, before you performed the autopsy, did you check for a pulse? WITNESS: No. ATTORNEY: Did you check for blood pressure? WITNESS: No.

The End Will Always Justifies The Means

Does the end always justify the means? Is it ok for a police officer to lie and get a known criminal off the street? Is it ok for a police officer to lie about your speeding ticket just to meet his quota for the month? Does the end always justify the means? We know a criminal on the street is just a crime looking to happen. We know that eventually, you are going to speed. Moreover, we know that if an officer does not issue enough traffic citations it looks bad for his performance evaluation. This is a dangerous situation, especially when the police apply this principal. More and more we are reading

Homeless? Bah Humbug!!

The CBS morning news carried a news item about the growing number of homeless in California. Two things caught my attention. One is that in California it is illegal to park on a public street and sleep in your car. Two, the people breaking this law are newly displaced former home owners. These criminals that are breaking the law by sleeping in their cars were law abiding middle class citizens just a few months ago. Why would normal law abiding middle class citizens turn to a life of crime overnight? One answer is the economy. As the gap between the haves and the have-nots gets wider crime tends

I Don’t Want To Say I Told You So, BUT I …

When the raid on the polygamous Fundamentalist Church of Jesus Christ of Latter Day Saints took place, about six weeks ago, Pancho Villa expressed some concern over the legalities of the raid (read it here). The raid on a ranch located near San Angelo Texas was a cooperative effort involving all law enforcement agencies of the State of Texas as well as local law enforcement. The object of the raid was to “rescue” the more than 450 children at the ranch from the so called “perverts”

Father Jailed for Daughter’s Crime

In an interesting story Foxnews reports that the father of an 18 year old girl will be released from jail today. He was jailed because the 18 year old girl refused to attend GED classes. To me, this is a very interesting case. Or should I say an interesting abuse of the legal system. According to this legal thesis, relatives of any criminal can and should be held to account for the crimes of other adults. An example: you give your 28 year old brother a helping hand by letting him stay in your spare bedroom. He robs the 7-11 down the street and the judge says “We can’t find your brother

murderers should be kept in prison

England's top judge has been slapped down after renewing his call for shorter prison sentences and arguing that murderers are being jailed for too long.Lord Chief Justice Lord Phillips argued in a speech that mandatory life sentences for murderers meant prisons risked becoming "full of geriatric lifers" and suggested they were compounding the prison overcrowding crisis.A Home Office spokesman said: "The Lord Chief Justice is entitled to his view and has expressed it. The Home Secretary believes that murderers and other dangerous offenders should be kept in prison as long as is necessary

prison violence is a consequence of overcrowding

According to official figures, an increase in violent incidents both between inmates and against prison staff is demonstrated. They show there were 2,971 violent incidents against prison officers in 2005 compared with 551 in 1996. Violent incidents between prisoners were 10,800 in 2005 compared with 1,791 in 1996.Juliet Lyon, director of the Prison Reform Trust, said that prison numbers have risen from 61,467 in 1997 to more than 80,000 today, with no proportionate rise in the number of prison staff, basic training cut back to just eight weeks and most governors moving on after less than two years
