    Great News in Colorado - Affiliates Not Mentioned in New Bill

    Tonight the Senate rolled out the new version of the state's internet tax bill, and the paragraph mentioning "affiliates" and the other language were removed. The bill was changed by the democrats to simply attempt to collect the taxes due to Colorado directly from the Colorado consumers themselves. As expected, the Republican Senators did not agree with this new bill for many reasons. Read the PMA Blog on this here .

    Now the bill focuses on mainly the purchases Colorado residents make from out of state retailers, and provides a method for collecting the taxes. It seeks to require all retailers in the nation (and perhaps the world) to provide Colorado with a statement concerning all purchases made by residents in the state at year end. It also requires all merchants to send to each Colorado resident a first class mail statement showing all the purchases they made during the calender year.

    So theoretically the state could then match the report they get from the merchants with the taxes the residents remit, and I guess then they can bill the rest for whatever is not paid. Anyway, all of this is in the bill, but my guess is that there might be some problems with it. However, since we affiliates were taken out of the bill, we should not be negatively affected by it and probably can keep our affiliate jobs and businesses.

    I will be blogging about this as it unfolds in the coming days. It does appear we are out of the woods at this point. My compliments to the lawmakers who listened to us and became aware of the potential of loss to us as a business community if merchants fired us under the old bill's language. I also give kudos to the team who I am calling the "inner team" who not only wrote letters as I did, but managed to meet with the lawmakers to convince them to keep us out of the language of the bill. This was a wonderful turn of events.

    I watched the entire proceedings tonight, and I will watch tomorrow as well on the Colorado Channel, Comcast 165. The debates were sometimes very spirited and exciting to watch. I believe all the lawmakers get to speak for 10 minutes on each bill, so that may happen tomorrow during the day. I do believe this is the first time we have seen an outcome quite like this one in any other state where we have had to fight for our jobs in affiliate marketing.

    Way to go Colorado Affiliates, and thanks to the lawmakers too.
